SBA Loan Default? We Can Help.

Expert legal assistance to protect your assets and resolve SBA loan defaults. Don't face the SBA or the BFS alone.

BFS CAN SEIZE ASSETS WITHOUT WARNING

Once your loan defaults and goes to the Bureau of Fiscal Services (BFS), they can levy bank accounts, garnish wages, and place liens on property. If your application has any irregularities, the government may also investigate for fraud.

Options if Your Loan is Sent to BFS

If your SBA loan defaults, it will be sent to the Bureau of Fiscal Services (BFS) for collection. You still have options:

1

Installment Agreement

Set up a plan to pay the full balance. The terms are less generous than the original SBA loan, so avoiding default is always the best first option.

2

Partial Pay Agreement

Allows you to pay less than the full amount owed over time. You must demonstrate to the BFS that you lack the financial ability to pay the full balance.

3

Offer In Compromise

Settle the full loan amount for a lump sum that is much less than the total owed. Qualification depends entirely on your financial situation.

Note: A 1099-C (Cancellation of Debt) form will be issued to the IRS, which is taxable income.

Note: Any collateral securing the loan must be liquidated before an Offer will be considered.

Your Questions, Answered

What if I'm being investigated for PPP/EIDL fraud?

The government is actively auditing loans for fraud. If there are any irregularities in your application, you need legal counsel immediately. We provide attorney-client privilege protection and can guide you through the investigation process.

How much does SBA default representation cost?

Your first consultation is 100% free. Representation fees vary based on case complexity. We offer flexible payment plans to make expert legal help accessible when you need it most.

Can I handle BFS negotiations myself?

You can, but BFS has strict procedures and documentation requirements. An experienced attorney knows their process, can protect you from making statements that hurt your case, and often achieves better outcomes. Attorney-client privilege also protects your communications.
